1. Who we are

Bumpo (the "Service") is operated by Mindysm OÜ, a private limited company registered in the Republic of Estonia, with its registered office in Tallinn, Estonia ("Mindysm", "we", "us", "our"). You can contact us at hello@bumpo.fun.

2. Acceptance of these terms

By accessing or using Bumpo, you agree to be bound by these Terms of Use (the "Terms"). If you do not agree with any part of the Terms, do not use the Service.

3. Eligibility

You must be at least 13 years old to use Bumpo. If you are under the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. The Service

Bumpo is a free browser-based multiplayer game. No account is required to play. The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice.

5. Acceptable use

You agree not to:

• use the Service for any unlawful or fraudulent purpose;
• harass, threaten, impersonate, or otherwise harm other players, including via nicknames or chat;
• attempt to disrupt, overload, reverse-engineer, decompile, or probe the Service or the networks that deliver it, including through automated scraping, denial-of-service, or exploitation of bugs;
• cheat, use unauthorised client modifications, or gain an unfair advantage;
• upload, transmit, or link to content that is illegal, infringing, defamatory, obscene, or otherwise objectionable;
• circumvent any access controls or technical measures protecting the Service.

We may, at our sole discretion, block, throttle, or ban users who violate these Terms, without notice or refund.

6. User content

Any nickname, display text, or other content you submit while using Bumpo ("User Content") remains yours. By submitting User Content, you grant Mindysm a worldwide, royalty-free, non-exclusive licence to host, display, and transmit that content to the extent necessary to operate the Service. You are solely responsible for your User Content and must ensure you have all rights necessary to submit it.

7. Intellectual property

The Service, including all software, graphics, sound, branding, and design elements, is owned by Mindysm OÜ or its licensors and is protected by Estonian and international copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you. You may play the game as intended; you may not copy, redistribute, or create derivative works without our prior written consent.

8. Third-party services

The Service may rely on third-party infrastructure (for example, cloud hosting). Your use of the Service is subject to the applicable third-party terms where relevant. We are not responsible for the availability or content of third-party services.

9. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or uninterrupted operation. We do not warrant that the Service will be error-free, secure, or continuously available.

10. Limitation of liability

To the fullest extent permitted by applicable law, Mindysm OÜ, its directors, shareholders, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Service. Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed one hundred euros (EUR 100). Nothing in these Terms limits liability for gross negligence, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be lawfully excluded under Estonian or EU law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall survive.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes become effective when posted. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws rules, and, where applicable, by mandatory consumer-protection provisions of European Union law. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Harju County Court (Harju Maakohus), Tallinn, Estonia, except where EU consumer law grants you the right to bring proceedings in the courts of your country of habitual residence.
